TOS

In order to ensure our services run smoothly, we have to set and enforce rules. These are the rules (or terms) for proxy hosting service of “Cloak Host”.

The Terms of Service (TOS) are the rules and regulations that specify guidelines for using our proxy hosting services. All use of our hosting services is subject but not limited to these terms. Please read them carefully and ensure that you understand and agree to all parts. Use of Cloak Host’s services implies agreement with these terms.

Proxy Hosting Policy ( Please read, VERY IMPORTANT! )

CloakHost.com (referred as “we” henceforth) allows and specializes in hosting php based web proxies only. Proxies are fully legal by US law. No CGI proxies are allowed they use far higher amount of resources, resulting in server instability issues. Only proxies please. Accounts hosting sites other than php web proxies will be warned and denied any kind of support.

Please don’t host very high traffic proxies. They should be earning enough revenue to get own dedicated servers. We offer hosting to starter and mid-traffic proxies only; our systems are not designed to host what we call “monster proxies”.

Proxy hosting by nature is server resource intensive. So, temporary slowdowns in page load/access times might occur during any time of the day, particularly the peak hours and is considered perfectly normal since the Internet traffic as a whole is huge at those times.

We recommend enabling hotlinking protection for your proxies to prevent leeching your bandwidth for no revenue and high server resource usage.

Every proxy hosted on our servers MUST have a human-readable TOS or disclaimer linked from the homepage so as to avoid any legal problems that might arise anytime.

System Resource Usage Policy

Our systems are not designed for hosting high to very high traffic proxies. Occasional traffic and resource usage spikes due to promotional activities are tolerable, but sustained high server resources ( predominantly high traffic proxies ) is not allowed. We will always try to ensure all proxies on the server run smoothly. Hence, very high traffic proxies are asked to move elsewhere.

Content Policy

All services provided by us may be used for lawful purposes only. No offending content will be allowed on our servers. This includes, but is not limited to: copyrighted material, material we judge to be threatening or obscene, or material protected by trade secret, etc. The subscriber agrees to indemnify and hold harmless Cloak Host from any claims resulting from the use of the service which damages the subscriber or any other party. Examples of non-acceptable content : copyrighted digital content, adult content, warez, pirated software, gambling, hacking / cracking, any content detrimental to the public. Running any kind of IRC, torrents, chat systems, mass mailers, newsletters, bots is strictly prohibited. Violators will be warned and account suspended if offending content is not removed.

Backup Policy

CloakHost.com keeps weekly offsite backups for it’s own administration and system maintenance purposes only. Please do not ask us to restore the latest backup except in emergencies. In such cases extra charges might apply. It is the sole responsibility of the client to take own backups whenever required. We will not be held responsible for any kind of data loss arising out of the client’s own errors.

Uptime Policy

Everyone hates downtime; so do we. However, due to the huge resource consuming and complex nature of shared proxy hosting, temporary server loads might spike and result in very small downtime or slowness. The expected uptime is around 99% but not officially guaranteed. Downtime due to server maintenance might occur and news about them will be posted at our website. In case of any unprecedented or unplanned downtime, it’s upto us whether to issue compensation credits to client accounts.

SPAM Policy

If we receive complaints or observe that spamming or any kind of mass mailing activity is being conducted from a client’s account in any way, the account will be suspended and the client notified. Failure to resolve the problem by the client will result in account suspension.

Billing, Cancellations, Refunds Policy

Clients are invoiced on the 1st. of every month (prorata billing) and intimated by email. Accounts with outstanding invoices due for 5 days are automatically suspended. It is the duty of the client to ensure that their contact email address on file is updated and valid; else we won’t be able to communicate with them.

Account cancellation requests should be submitted officially through the client area only. Upon confirming the cancellation requests, the accounts are terminated.

All cancellations should be requested on or before the end of the month to prevent being billed for the next month.

All funds sent to Cloak Host is generally non-refundable. However, it’s up to our sole discretion whether to partially or fully refund funds in special cases.

Privacy Policy

All personal information collected by Cloak Host from it’s clients is for internal administration and billing purposes only. We will not share, trade or sell such personal information; your privacy will be honored.

Disclaimer

Cloak Host will NOT be held responsible for any kind of loss - whether personal, financial or otherwise, incurred while using our services. Cloak Host is not liable for any unethical actions, misdeeds or unlawful actions of it’s clients.

TOS Compliance

CloakHost.com reserves the right to modify or revise the TOS anytime, at it’s sole discretion without any prior notice.

Failure to fully comply with these terms is grounds for account suspension and/or deactivation (with or without refund, subject to Cloak Host’s discretion). Any account contained within Cloak Host’s network must adhere to the above policies.

We reserve the right to remove any account without prior notice, if the situation demands so. If we deactivate your account for violating policy, you will forfeit your rights to a refund; and none will be given. No refunds for advanced payment. Our normal policy is a warning first, and account deactivation the second offense, but no warning is required.
